Immigration Terms of Service

1.   Parties and Background

a)          Temple & Green Ltd, a company incorporated in England and Wales with company number 13481467 and registered office at Unit 38, Innovation House, Innovation Way, Discovery Park, Sandwich, England, CT13 9FF (the “Company”); and

b)          any person or entity that purchases services from the Company, accepts a proposal or order form issued by the Company, completes an online sign-up process referring to this Agreement, or otherwise indicates acceptance of this Agreement, whether online or in writing (the “Client”).

The Company provides immigration advice and services, which is delivered and regulated by the Immigration Advice Authority (IAA) under regulation number F202538447

This Agreement will become binding between the Company and the Client on the Effective Date, as defined in Section 2.8 and further described in Section 14.

2.   Definitions

In this Agreement, unless the context otherwise requires, the following definitions shall apply:

2.1              “Advanced payment” means that an upfront payment is expected on the agreed fixed fee, before any work can be commenced.  

2.2              “Agreement” means these Terms of Service, including any schedules or appendices attached hereto. 

2.3              “Business Day” means any day other than a Saturday, Sunday or public holiday in England when banks in London are open for business.

2.4              “Cooling Off Period” means the period of 14 days from the Effective Date.

2.5              “Confidential Information” means any information disclosed by either party to the other in any form that is marked or identified as confidential or that ought reasonably to be treated as confidential.

2.6              “Services” means the immigration advice and support services described in Section 3 of this Agreement. 

2.7              “Term” means the period from the commencement of this Agreement until its termination in accordance with Section 11.

2.8              “Effective Date” means the date on which the Client first accepts this Agreement, pays the agreed fee and instructs the Company to commence the Services.

3.   Scope of Services

Temple & Green provides professional immigration advice and assistance to individuals seeking to apply for a visa, settle in the UK, or navigate the immigration process.

3.1              Services include:

a)     Business Visitor visa guidance and completion.

b)    Individual & Family visa assistance and completion.

c)     Student visa application support, guidance, and completion.

d)    Basic immigration guidance for employers and completion.

e)     Document and application checking.

f)     Explanation of Home Office procedures and decisions in relation to applications we have prepared or supported.

3.2              Temple & Green Ltd is authorised and regulated by the Immigration Advice Authority (IAA) under registration number F202538447. The Company is authorised to provide immigration advice and services at Level 1 and within its authorised categories, and the Services under this Agreement are limited accordingly. If a matter falls outside our authorised level (or becomes so during the course of instructions), we will inform you and discuss appropriate next steps, which may include referral to another suitably authorised adviser. 

4.   Consultation and Service Refund Policy 

4.1              Initial Consultations

4.2              Cancellations of initial consultations/advice sessions, Temple & Green must be notified 48 hours prior to the advice session’s date. 

4.3              Reschedule requests must be made at least 24 hours before the advice session takes place. 

4.4               Application packages, document services and other

4.5              If a service is cancelled within the Cooling Off Period, you are entitled to a refund, subject to the deduction of a proportionate amount reflecting the Services provided up to the date of cancellation, together with any non-recoverable third-party costs incurred with your approval.

4.6              If work has been carried out by Temple & Green by request and consent during the timeframe, a refund will be determined on a case-by-case basis to cover the value of the work carried out. 

4.7              If cancellation occurs after the Cooling Off Period, refunds will be determined in accordance with the Client Care Letter and the value of Services already provided.

5.          Initial Consultation

5.1                An initial consultation will be conducted to assess your eligibility for immigration services and determine the appropriate course of action. As an IAA-regulated immigration advice provider, the consultation may be over the phone, in person or through video conferencing.  During the initial consultation, you could expect the following:

5.2                You will receive advice on your eligibility for the visa or immigration service you are seeking.

5.3                Advice on any immigration matters you may have

5.4                A description of how we work and your next steps

If you decide to proceed with our services, the details will be included in your Client Care Letter, which will be sent following the initial consultation.

6.          Client Care Letter

Following the initial consultation, a Client Care Letter will be issued to you. This letter:

6.1                  Provides a summary of the advice session and includes any fees applicable.

6.2                  Details the estimated timeframes for processing your case.

6.3                  Outlines your responsibilities and the information required to proceed with your case.

6.4                  Includes a summary of our refund terms and cancellation policy. 

6.5                  Provides details on how to make a complaint if you are unsatisfied with the service given

The Client Care Letter will serve as a formal agreement between you and Temple & Green for the services to be provided.

7.          Fees 

7.1                  Advance Payment: All services provided by Temple & Green require advance payment. The payment amount will be confirmed in your Client Care Letter. No work shall be carried out until payment on the agreed fee has been received.

8.          Client Responsibilities

8.1                You agree to provide us with all necessary and accurate information and documentation to facilitate the immigration process. Failure to provide the required documents or misleading information could lead to delays, complications, refusal of your visa application and termination of services with Temple & Green.

8.2                You must notify us immediately of any changes to your circumstances that could affect your application, including changes in your contact details, employment status, or any criminal matters.

8.3                Documents requested by an Immigration Advisor at Temple & Green are crucial to an application's success. 

9.          Third-Party Costs

9.1                  You may be required to pay third-party costs in addition to the fees charged by Temple & Green. These may include Government fees (Home Office visa application fees, biometric fees, etc.)

9.2                  Temple & Green will provide you with an estimate of these costs during the consultation, and you will be responsible for these expenses. Home Office application fees and related government charges are payable directly by you to the relevant authority unless expressly agreed otherwise in writing.

10.       Confidentiality and Data Protection

10.1             Temple & Green is committed to protecting your personal and sensitive information in compliance with the General Data Protection Regulation (GDPR) and the Data Protection Act 2018. We process personal data to provide the Services, communicate with you, submit applications on your behalf, and comply with legal and regulatory obligations.

a)     Purpose of Data Collection: We collect and process your personal data to provide immigration advice, submit applications on your behalf, and maintain communication throughout the immigration process, and comply with our professional and regulatory obligations.

b)    Lawful Basis for Processing: Our lawful basis for processing personal data is typically the performance of a contract with you and compliance with legal and regulatory obligations. Where necessary for immigration matters, we may process special category data in accordance with applicable data protection laws.

c)     Data Security: We implement appropriate technical and organisational measures to safeguard your data. Your information will be stored securely and will only be shared with relevant authorities, government bodies, or third parties involved in your immigration matter where necessary.

d)    Retention of Data: Client files and records will be retained for at least six years after file closure in accordance with regulatory requirements. We may retain data for a longer period where required for legal, regulatory, or insurance purposes. After the applicable retention period, personal data will be securely deleted or anonymised where appropriate.

e)     Your Rights: You have the right to request access to, correction of, or deletion of your personal data, and other rights available under UK GDPR. 11.       Termination of Services

 11.1             If you are a consumer, you have the right to cancel this Agreement within 14 days from the Effective Date (the Cooling Off Period.

11.2             If you request that we begin providing the Services during the Cooling Off Period and you later cancel within that period, you will be required to pay a proportionate amount for the Services provided up to the time of cancellation, together with any non-recoverable third-party costs incurred with your approval.

 11.3             To cancel your request, you must promptly notify the immigration advisor assigned to you either by phone or email, as specified in these terms.

11.4             Temple & Green reserves the right to terminate services if:

a)     You fail to comply with your obligations as outlined in the Client Care Letter.

b)     You provide false or misleading information.

c)     You are unable to provide documents that are imperative to the success of your case

d)     We are unable to proceed with your case for any reason, including legal or regulatory constraints.

11.5               If a service (excluding Initial Consultation) is cancelled within the 14-day period, a £150 cancellation fee applies.

12.       Liability

 12.1             Temple & Green will provide immigration advice and services with reasonable care and skill. We cannot guarantee any particular outcome and are not responsible for decisions made by the UK Home Office, other government authorities, or third parties involved in your immigration process. 

13.       Complaints and Disputes

 13.1             If you are dissatisfied with any aspect of the services provided, you may submit a complaint in writing to info@temple-green.co.uk or to our registered office address. We will acknowledge your complaint within 5 Business Days and aim to provide a substantive written response within 28 days. We maintain a central complaints log. You may complain to the Immigration Advice Authority (IAA) at any time. Information on how to complain to the IAA is available on GOV.UK.

14.       Governing Law

 14.1             These Terms and Conditions and any dispute or claim (including non-contractual disputes or claims) arising out of or in connection with them are governed by the laws of England and Wales. The courts of England and Wales shall have exclusive jurisdiction. 

15.       Execution

 15.1             The parties agree that this Agreement may be entered into and become legally binding. The Client shall be deemed to have accepted this Agreement and entered into it with the Company on the Effective Date if the Client does any of the following.

a)     completes an online sign-up or onboarding process that refers to this Agreement;

b)     clicks the “I agree” checkbox in connection with this Agreement or any proposal, order form or online checkout that incorporates this Agreement;

c)     pays an invoice or subscription fee issued by the Company, which refers to this Agreement; or

d)     instructs the Company to commence the Services after receiving a copy of this Agreement or being given a link to where it is hosted online.

e)     We must keep a record of the Client’s agreement to the Client Care Letter. This may be evidenced by a signed copy or electronic confirmation.

By engaging with Temple & Green Ltd, you acknowledge that you have read, understood, and agree to these Terms and Conditions.
